1. Agreement to these terms

These terms govern your use of hyalabody.com and purchases from Hyala (we, us or our). By accessing the site, creating an account or placing an order, you agree to these terms and our Privacy policy. If you do not agree, please do not use the site or place an order.

2. Who can place an order

You must be at least 18 years old, or have the permission of a parent or guardian, to place an order. You must provide accurate, current contact, payment and delivery information. You are responsible for keeping your account credentials confidential and for activity that occurs through your account.

3. Product information

We work to describe and photograph products accurately. Colours, finishes and packaging can appear differently depending on your device and may change from time to time. Product information is general information only; it is not medical advice. Unless a product page displays a verified TGA/ARTG reference, our products are not represented as treating, preventing, curing or relieving a medical condition. Please follow all product instructions and consult a qualified health professional where appropriate.

4. Pricing, payment and availability

Prices are shown in Australian dollars unless stated otherwise. Applicable shipping charges and any available taxes are shown at checkout before you pay. We may change prices, promotions, product availability and specifications at any time, but these changes will not affect an order we have already accepted.

Payment is processed by Stripe Checkout. By submitting payment details, you confirm that you are authorised to use the selected payment method. We may cancel or refuse an order where payment cannot be authorised, a price or listing error has occurred, stock is unavailable, or we reasonably suspect fraud or unauthorised activity. If we cancel an accepted order for one of these reasons, we will refund amounts paid for the cancelled items.

5. Orders and order acceptance

Submitting an order is an offer to purchase the items in your cart. Your order is accepted when we send a dispatch confirmation, or when we otherwise confirm acceptance in writing. An automated order receipt does not by itself mean that we have accepted your order.

Please check your order and delivery details carefully before payment. Contact support@hyalabody.com promptly if you need help with an order. We cannot guarantee that changes or cancellations can be made after an order enters fulfilment.

6. Delivery and pre-orders

Delivery, tracking, estimated delivery windows, international orders, customs charges and return-to-sender arrangements are set out in our Shipping policy. Delivery estimates are estimates only and can change due to carrier, customs, weather or other factors outside our reasonable control.

A pre-order reserves an item before it is available for dispatch. Any stated dispatch date is an estimate. Where an order includes pre-order and in-stock items, we may send the order together once all items are available unless we agree otherwise.

7. Returns, refunds and consumer guarantees

Our returns process, including eligibility and how to contact us, is set out in our Returns policy. Nothing in these terms or that policy excludes, restricts or modifies any rights or remedies you may have under the Australian Consumer Law or other applicable law.

Where the Australian Consumer Law applies, our goods come with guarantees that cannot be excluded. You may be entitled to a replacement or refund for a major failure and compensation for other reasonably foreseeable loss or damage. You may also be entitled to have goods repaired or replaced if they fail to be of acceptable quality and the failure does not amount to a major failure.

8. Acceptable use

You must not misuse the site, interfere with its security or operation, introduce malicious code, scrape or collect data without permission, use another person's account, or use the site for unlawful, fraudulent or abusive purposes. We may suspend or restrict access where we reasonably believe these terms have been breached.

9. Intellectual property

The site, including its content, branding, images, product copy, logos and design, is owned by or licensed to Hyala and is protected by intellectual property laws. You may use the site for personal, non-commercial shopping purposes only. You must not reproduce, adapt, distribute or commercially use site content without our prior written permission.

10. Liability

To the maximum extent permitted by law, we are not liable for indirect, incidental, special or consequential loss arising from your use of the site or products. Nothing in these terms limits liability where it would be unlawful to do so, including liability under the Australian Consumer Law.

11. Changes to these terms

We may update these terms from time to time by publishing the revised version on this page. The updated terms apply from their publication date. The terms that applied when you placed an order continue to apply to that order, except where a change is required by law.

12. Governing law and contact

These terms are governed by the laws of New South Wales, Australia, and the parties submit to the courts of New South Wales and their appeal courts, subject to any mandatory consumer-protection laws that apply to you. For questions about these terms or an order, contact support@hyalabody.com.
